Kaleidoscope Transformation Collective (“Company,” “we,” “our,” or “us”) respects your privacy and is committed to handling your information with care, transparency, and integrity.

These Terms of Use (“Terms”) govern your access to and use of the Kaleidoscope Transformation Collective platform, including all digital tools, memberships, AI-powered experiences, courses, content, and services (collectively, the “Platform”).

By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Scope of Use

These Terms apply to:

  • All users of the KTC platform and membership site (free and paid tiers)

  • All digital tools, including AI-powered tools and GPT experiences

  • Courses, trainings, recordings, and educational materials

  • Community spaces, messaging, and shared content

  • Coaching services, if purchased in addition to platform access

This is a digital membership and SaaS-based environment.

2. Account Registration & Responsibility

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and current information

  • Maintain the confidentiality of your login credentials

  • Be responsible for all activity under your account

You may not:

  • Share your login with others

  • Resell or transfer your account

  • Attempt to bypass access levels or tier restrictions

We reserve the right to suspend or terminate accounts for misuse.

3. Membership Tiers & Access

Your access depends on your selected tier (e.g., Free, Mid, Premium).

Each tier may include:

  • Digital tools and AI experiences

  • Content libraries and courses

  • Community access

  • Ongoing updates and new releases

We reserve the right to:

  • Modify features within tiers

  • Add or remove tools

  • Update pricing or structure

  • Change the name and content of each tier

If changes significantly impact your access, we will provide reasonable notice.

4. AI Tools & Generated Content

The Platform includes AI-powered tools designed to support reflection, insight, and transformation.

By using these tools, you understand:

  • Outputs are generated based on your inputs and are not guaranteed to be accurate, complete, or personalized advice

  • AI tools are for educational, reflective, and informational purposes only.

  • They do not replace professional advice (medical, psychological, legal, or financial)

You are responsible for how you interpret and use AI-generated content.

5. Recordings, Transcripts & Content Use

As part of the Platform experience, we may provide:

  • Recorded trainings, classes, or sessions

  • AI-generated transcripts and summaries

  • Downloadable or replayable content

If you participate in live experiences (courses, group calls, or sessions):

  • These may be recorded and transcribed

  • Recordings may be used for internal training, quality, or educational purposes that could be shared with others.

  • Replays may be shared within the Platform or outside of it

Your participation indicates consent unless you notify us in advance. You may turn off your video camera if you do not want your picture viewed.

We will never publicly share your personal contributions without permission.

6. User-Generated Content & Community

If you post, share, or submit content (including within community spaces or AI tools), you:

  • Retain ownership of your content

  • Grant us a limited license to use it within the Platform for functionality and experience delivery

You agree not to post:

  • Harmful, abusive, or discriminatory content

  • Confidential or sensitive third-party information

  • Content that violates any laws or rights

We reserve the right to remove content or restrict access to protect the integrity of the space.

7. Intellectual Property

All Platform materials—including:

  • Tools, GPTs, frameworks, and methodologies

  • Videos, recordings, courses, and written content

  • Branding, language, and proprietary processes

Are owned by Kaleidoscope Transformation Collective and protected by law.

You may:

  • Use content for personal growth and learning

You may NOT:

  • Copy, reproduce, share, or distribute content

  • Record or republish materials

  • Use content for your own business, training, or resale

8. Payments, Subscriptions & Refunds

By purchasing access, you agree to:

  • All payment terms at checkout

  • Any subscription billing cycles (monthly or annual)

  • Completing payment plans in full

Subscription Terms:

  • Your membership may auto-renew unless canceled

  • You may cancel before the next billing cycle

Refunds:

  • Digital products, memberships, and AI tools are non-refundable once accessed

  • Coaching and high-touch services follow separate refund terms

9. Platform Availability

We aim to provide a consistent experience, but:

  • Access may occasionally be interrupted due to updates or technical issues

  • Features may evolve as the platform grows

We are not liable for temporary disruptions.

10. Health & Personal Responsibility Disclaimer

All content, tools, and experiences are:

  • Educational

  • Informational

  • Transformational

They are not medical, psychological, or therapeutic treatment.

You are responsible for:

  • Your decisions

  • Your interpretations

  • Seeking licensed support when needed

Results are not guaranteed.

11. Third-Party Tools & Integrations

We may use or integrate with third-party services, including:

  • AI tools

  • Payment processors

  • Hosting platforms

  • Video or communication tools

We are not responsible for their performance, policies, or security practices.

12. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for:

  • Indirect or consequential damages

  • Loss of data, income, or opportunity

  • Decisions made based on Platform content

Maximum liability is limited to the amount you paid for the service.

13. Termination of Access

We may suspend or terminate access if you:

  • Violate these Terms

  • Misuse the Platform

  • Disrupt the experience for others

You may also discontinue use at any time.

14. Governing Law

These Terms are governed by the laws of the State of Idaho, United States.

Any disputes will be resolved through binding arbitration in Idaho.

15. Updates to Terms

We may update these Terms at any time.

Continued use of the Platform indicates acceptance of any updates.
